Open Question: Should she be paid for the time she worked?

My younger sister works at a small restaurant. She has been been working the dinner shift and gets paid for 2.13 per hour as a waitress. She recently got her first pay check and she was not paid for after hours work she had done. The restaurant closes at 9:00 and she has stayed after that to clean and roll silverware for the next day. In her pay check, the 2 hours extra that she has been staying, she wasn't paid for. She didn't clock out, yet she wasn't paid. Is there a law in Virginia that protects her from this?
